§ 1151 and Federal Tort Claims for Bradford County Veterans
Bradford County has no VA clinic of its own. Veterans in Starke, Lawtey, Hampton and Brooker travel either to the Malcom Randall VA Medical Center in Gainesville, about twenty-five miles southwest, or to the Lake City VA Medical Center to the northwest. Camp Blanding sits on the county’s eastern edge, and a substantial share of Bradford County’s roughly 2,000 veterans served in the Gulf War era.
That means Bradford County veterans receive their VA care at the two hospitals of the North Florida/South Georgia Veterans Health System — the system we have litigated against from our Gainesville office for fifty years, roughly half an hour from Starke. We are closer to Starke than to any other county we serve.
If VA medical care caused a new disability, 38 U.S.C. § 1151 requires the VA to rate and compensate that disability as though it had been incurred in service. There is no filing deadline. If the injury occurred within the last two years, we will also present a Federal Tort Claim for a lump-sum recovery, filed in the U.S. District Court for the Middle District of Florida, Jacksonville Division.
