VA Medical Malpractice at Brevard-Area VA Facilities
Most Brevard County veterans receive their VA care through the Orlando VA Healthcare System, including the Viera VA Outpatient Clinic and other community clinics along the Space Coast. Veterans injured by negligent care at a VA facility deserve accountability, and we pursue it in two ways.
If the veteran was injured within the last 2 years, we will pursue a Federal Tort Claim on behalf of the veteran, seeking a lump-sum recovery from the United States. Brevard County cases are litigated in the U.S. District Court for the Middle District of Florida, which sits in Orlando — and we practice in all three federal district courts in Florida.
Additionally, no matter when the injury occurred, we will pursue an 1151 claim (pursuant to 38 U.S.C. § 1151) — a VA disability compensation claim for veterans who suffered an additional disability caused by VA medical care. Once the VA acknowledges the injury was caused by medical negligence, it rates the injury as if it were service-connected.
