§ 1151 and Federal Tort Claims for Suwannee County Veterans
There is no VA clinic in Live Oak. The roughly 3,200 veterans of Suwannee County receive their care primarily at the Lake City VA Medical Center, about twenty-five miles east — one of the two hospitals in the North Florida/South Georgia Veterans Health System. More complex surgical care goes to the Malcom Randall VA Medical Center in Gainesville.
Both are hospitals we know. Our office is in Gainesville, roughly an hour and fifteen minutes from Live Oak, and we have been litigating against this health system for fifty years.
If VA care caused an additional disability, 38 U.S.C. § 1151 requires the VA to compensate it as though it were service-connected. There is no time limit — we regularly file § 1151 claims on injuries that are decades old. A Federal Tort Claim, which seeks a lump-sum recovery instead, must be presented within two years, and suit is filed in the U.S. District Court for the Middle District of Florida, Jacksonville Division, which by statute also sits at Live Oak.
