VA Medical Malpractice at Villages-Area VA Facilities
The Villages VA Outpatient Clinic is part of the North Florida/South Georgia Veterans Health System — the same system headquartered at the Malcom Randall VA Medical Center here in Gainesville. Veterans injured by negligent care at a VA facility deserve accountability, and we pursue it in two ways.
If the veteran was injured within the last 2 years, we will pursue a Federal Tort Claim on behalf of the veteran, seeking a lump-sum recovery from the United States. We practice in all three federal district courts in Florida.
Additionally, no matter when the injury occurred, we will pursue an 1151 claim (pursuant to 38 U.S.C. § 1151) — a VA disability compensation claim for veterans who suffered an additional disability caused by VA medical care. Once the VA acknowledges the injury was caused by medical negligence, it rates the injury as if it were service-connected.

Do I need a veterans attorney located in The Villages?

My condition has gotten worse since I retired. Can my rating be increased?
Yes. If a service-connected condition has worsened, you can file for an increased rating. A higher rating means higher monthly compensation and may qualify you for additional benefits such as TDIU or Special Monthly Compensation (SMC).
The VA denied my claim years ago. Is it too late?
Not necessarily. You may be able to file a supplemental claim with new evidence, and in some cases a Clear and Unmistakable Error (CUE) motion can reopen a final decision even decades later — with benefits paid retroactively.
