§ 1151 and Federal Tort Claims at The Villages VA Clinic
The Villages VA Clinic at 8900 SE 165th Mulberry Lane is one of the largest outpatient facilities in the North Florida/South Georgia Veterans Health System — roughly 95,000 square feet, with about 15,700 enrolled veterans. It is part of the same system as the Malcom Randall VA Medical Center in Gainesville, where we have practiced for fifty years.
Sumter County has one of the highest concentrations of veterans in Florida — more than 18,000 — and the oldest profile of any county we serve. Nearly 10,000 are Vietnam-era veterans, and more than 1,900 served in Korea or the Second World War. That demographic produces a particular pattern of VA medical injury. Older patients face higher complication rates from the same procedure, and the conditions being treated are the ones where a surgical error or a missed diagnosis produces permanent additional disability. It is also the population most affected by Agent Orange presumptives and by PACT Act claims.
When VA care causes a new disability, 38 U.S.C. § 1151 requires the VA to compensate it as though it were service-connected. There is no time limit on a § 1151 claim. A veteran injured at a VA facility in 2009 can still file one today.
Federal Tort Claim suits arising in Sumter County are filed in the U.S. District Court for the Middle District of Florida, Ocala Division, and must be presented to the VA within two years.

My condition has gotten worse since I retired. Can my rating be increased?
Yes. If a service-connected condition has worsened, you can file for an increased rating. A higher rating means higher monthly compensation and may qualify you for additional benefits such as TDIU or Special Monthly Compensation (SMC).
