Quick answer: Possibly. The PACT Act was signed on August 10, 2022, and for many toxic-exposure claims that date — not the date you applied — should control the effective date of benefits. The VA has acknowledged that more than 28,000 veterans received awards computed from their application dates instead, resulting in incorrect, reduced past-due benefits. If you received a PACT Act disability award, you may be owed additional back pay.
What the PACT Act Did
The Sergeant First Class Heath Robinson Honoring our PACT Act is the largest expansion of VA benefits in a generation, adding more than 20 presumptive conditions for burn-pit and airborne-hazard exposure and expanding Agent Orange presumptions. Veterans who filed during the first year were entitled to benefits backdated to August 10, 2022.
The Error
